These Terms of Service ("Terms") govern your use of growthtuning.com (the "Site") and any consulting, marketing, analytics, or related services delivered by Growth Tuning ("we", "us", "our"). By using the Site or engaging our services, you agree to these Terms. If you do not agree, do not use the Site or our services.

Note on individual engagements. Paid consulting or service engagements are governed by a separate written proposal, statement of work, or contract. Where those documents conflict with these Terms, the individual engagement document controls for that engagement.

1. Who we are

2. Use of the Site

You may use the Site to read our content, learn about our services, and contact us. In using the Site, you agree not to:

Attempt to gain unauthorised access to any part of the Site, its servers, or connected systems

You may share our public blog posts with attribution and a link back to the original page. All other uses require our prior written consent.

4. Services and engagements

The Site describes services we offer. It is marketing material, not a contract. Any actual engagement — including scope, deliverables, timeline, fees, and payment terms — is set out in a separate proposal, statement of work, or agreement signed by both parties.

Descriptions on the Site may change without notice as we refine our offerings. Statistics, case studies, and results shown on the Site are examples and are not a guarantee of any particular outcome for your business.

5. Payments and refunds

Fees, payment schedule, and refund policy for any paid engagement are set out in the applicable engagement document. Unless otherwise agreed in writing, invoices are payable in the currency stated on the invoice within 15 days of issue, and completed work is non-refundable.

6. Third-party services and links

The Site may link to third-party websites (for example blog articles, tool providers, or industry references). We are not responsible for the content, privacy practices, or availability of third-party sites. Links are provided for convenience only and do not imply endorsement.

7. Disclaimers

The Site and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses. You use the Site at your own risk.

8. Limitation of liability

To the maximum extent permitted by law, Growth Tuning, its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or its content, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or related to the Site is limited to USD 100 or the total amount you have paid us for services in the 12 months preceding the claim, whichever is greater.

9. Indemnity

You agree to indemnify and hold Growth Tuning harmless from any claim, demand, or damages, including reasonable legal fees, arising out of your breach of these Terms or your misuse of the Site.

10. Termination

We may suspend or terminate your access to the Site at any time, without notice, if we reasonably believe you are in breach of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page shows when they were last changed. Continued use of the Site after changes are posted means you accept the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Growth Tuning is established, without regard to conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Site will be resolved in the courts of that jurisdiction. If you are a consumer in the European Union or United Kingdom, this clause does not remove the protections available to you under mandatory local law.

13. Miscellaneous

If any part of these Terms is held to be unenforceable, the remaining parts will remain in effect. Our failure to enforce any provision does not waive our right to enforce it later. These Terms, together with any applicable engagement documents and our Privacy Policy, are the entire agreement between you and us regarding the Site.
